直至凌晨一時，MSN/ICQ還是不停。也是我吹水比較多吧，但這時候總不成拿我平日那自閉式的回應召待那些熱心的人士。
明天，是一戰。
其實也不是甚麼與甚麼之間的戰爭，我相信很多事情可以理性地解決。不對人，不對物，甚至不對事。我只希望明天的社會會更好——起碼不要更壞。我個人不愛說對錯。每件事情的發生，也有其背後原因。警方對這事件的一系列行動，背後的原因，不難猜想。「你有壓力，我有壓力」，其實我個人是明白的。我參與這次的行動的主因，並非為了討伐已發生的事，而是希望警方明白，他們處理這次事件手法上的種種問題。也希望大眾及社會各界關注及明白這些問題。
至於「這些問題」確實是甚麼呢，抱歉地說，並非三言兩語能說得清。我沒甚麼文彩，這幾天不少人問我這次遊動的目的是甚麼。其中包括熟悉政治、法律的知識份子。我也花了長篇大論，才把想說的信息傳達。抱歉我的中文差，自小讀的書大都是「雞腸」，反而不懂以中文表達。身為中國人，實在感到羞愧…老實說，我的「雞腸」也不到家。不過我想，既然認為事態嚴重，就算被取笑也要寫出來，讓大家一評。
Under our legal/justice system, the police are given a wide discretion in prosecuting suspects. They are given the power to decide, according to circumstances, whether to prosecute, who and when to prosecute, and the charges to make against the accused. As the saying goes, "where there's a right there's a duty". Obviously we hope, and we expect that they exercise this discretion in a fair and just manner, according to the spirit of the rule of law, and with regards to our entrenched rights in the Basic Law.
What we see in the police's reactions to the photos, however, is basically contrary to all the aforementioned duties and our expectations. Of course before I dwell further I must say that we have no conclusive evidence that the police exercised their discretion inappropriately, but the implication is so strong that we cannot dispel our doubts on the matter. Apparently, the police had always turned a blind eye to online distribution of obscene/indecent materials. I'm not trying to argue that distributing such materials is "not bad", nor that it is of right to do so, it's simply a fact that the police seemed to care little about these materials circulating on the Internet. In fact those "adult" sites are still going strong, with people posting obviously indecent materials online, and there is no word that the police are going to do anything about it.
Obviously there's something special about the leaked photos. That's something the police and the public can agree on. A petty case of "suspected" violation of obscenity laws, and the police seemed to pour in all their resources to deal with the case. I should know better than to accept hearsay as truth, but there are unreliable sources informing me that the police gave the event an unusually high level of attention, and not even high profile murder cases have been given such attention.
Undoubtedly stopping the circulation of those photos is indeed an important task -- we have seen its wide and deep penetration despite the police's furious attempts to quash the distribution. But we must ask whether their actions have gone too far.
Obviously we cannot point to any single action from the police which warrants such a negative reaction from fellow "netizens". Firstly a seemingly arbitrary arrest of an unemployed "poor" chap suspected of doing something nasty with the photos, then took him into custody for 8 weeks without bail. Then an announcement from the Commissioner of Police that "possession of the photos *may* constitute an offense" (I thought the Commissioner should have better things to do than to give an explanation of obscenity laws... and get it "wrong"). Then in the midst of all the negative press the police announces that they have found the "source" of the photos, only to shoot themselves in the foot when more photos were leaked.
As mentioned, we can't deduce anything with certainty. But what it seems to me, and many people would probably agree, is that the police were under some extraordinary "pressure" to deal with the case as "quickly" and "efficiently" as possible. As to what "pressure" this is we can only speculate, but it's fair to say that such an reaction is obviously out of the norm. Even absurd is the Commissioner of Police's "explanation" of the obscenity laws, which is widely perceived to be a thinly disguised threat to all law abiding "netizens" who had been simply viewing the photos out of curiosity. The announcement that the "source" is found seems to be a pathetic attempt to cover up their recent missteps, and while I can assume it is technically not a lie, it is at best an attempt to make the public think that the police are more competent than they really are. Anybody with half a brain would consider the possibility that the real "perpetrator(s)" could always release more photos and thus discredit the claim. I actually for a moment presumed that the police would not be so stupid to allow this to happen, that I thought they really got the "real person" behind this. Needless to say, I was wrong.
What does this mean? Well it seems that the police are, as they should, very familiar with the law and procedures. There's apparently nothing wrong with their actions in law, and apparently nothing procedurally wrong either. Everything that they have done is apparently within their powers or discretion. Yet what they have done in reality, I would think, amounts to infringing all sorts of basic human rights.
Taking Mr. Chung into custody for almost two months practically amounts to depriving his right to a fair trial. With respect it might seem to be an err on the part of the magistrate, but the prosecution is not supposed to make obviously unreasonable submissions. Although professional opinion on the matter may vary, and I am in no position to give such opinion on the matter, I personally do not see any justifiable reason for the submission to refuse bail.
The Commissioner's statement that "possession *may* constitute an offense", as mentioned, is perceived to be a thinly disguised threat. In practice, the statement, together with the circumstances of Chung's arrest, created a "reign of terror" which effectively halted the circulation of the photos to some extent. Let me spell out the threat as I perceive it, as nobody seems to have the courage to do so: "We, the police, are watching what you are posting online, and we will take drastic actions on any minute evidence that you *may* have been doing anything illegal, as seen in the case of Chung, and we can make your life very difficult. We can put you in jail for weeks without any proper trial, and you don't want that to *possibly* happen to you, right? Trust us, you have seen how efficient we are." Obviously I do not read minds other than my own, and while I have no idea what the Commissioner had in mind when he gave the statement, I knew perfectly well what I was thinking myself.
I'm no expert on public law, but somehow this threat does not seem to ring well with our supposed right to freedom of speech. There's some delicate "balancing" to be done between our freedom of speech and other social concerns such as preventing spread of indecent/obscene materials. I admit that I've never really understood how it's actually "balanced", but it doesn't take a legal expert to see that there's something wrong. Apparently much of the public, who's probably not as versed in legal letters, have second doubts on expressing themselves in a perfectly legal way, even as so far as to doubt whether our protest would be sabotaged by a politically biased police. I'm personally grateful that the police had been cooperative and helpful to us organizers with respect to the protest, but that does not negate the fact that the public were intimidated by fear to keep our mouths shut on the matter.
The premature call of triumph was in retrospect, less enraging than pathetic. I actually had a bit of sympathy for the police when the photos continued to spread. For one reason or the other they decided it was a politically sound move, or perhaps on second thought it was more likely a desperate bet that somehow, the "real perpetrator" would cease to distribute more photos. Yet despite my sympathy to the police that they were fighting a losing battle, it is extremely alarming that the police would even consider such a "cover up" to be viable. Though as I have mentioned, it may be technically true that they've found the "source" (for some definitions of "source", even if it means Mr. Edison Chan's computer), the implication that they've "solved the case" is so strong that we cannot help but raise doubts on the police's integrity.
I would have written these events off as a serious of really unfortunate mistakes the police have made if not for their apparently blatant and shameless attempts at misleading the public and their absolute lack of respect for our of civil and political rights. Their actions may have been perfectly compliant to the letter of the law, but the spirit of fairness, equality, freedom, such rights protected by the Basic Law, had been "legally" violated. It is extremely disturbing to think how many covert cases of such "abuse" have not been uncovered, and how "successful" they have been to lead them to believe, either arrogantly or ignorantly, that they would "succeed" again in dealing with such a high profile case.
What disturbs me even more is the lack of formal mechanisms to keep the police in check. The courts can generally only deal with individual cases, and cannot dictate police policy. A democratically elected government could theoretically alleviate the problem, but that's only when police powers are a topic of active political debate. To request the police to exercise self regulation, through their "Complaint Against Police Office", is a futile request when their "First in Command" weighs in on the matter.
"Power corrupts" aptly describes the situation. I attribute no malice on the part of the police, since it's a fact of life that a body entrusted with great power would inevitably grow out of control if there are no efficient checks and balances to keep it in place. The only possible avenue of rectification is through public pressure, which is (one of the reasons) why I have, despite my usual political inertness, decided to actively engage in the matter.
What I genuinely and sincerely hope is that the police could learn from these series of events and thoroughly review their policies (as to basically everything). I understand that it is a tough job in balancing the need to fight crime and to uphold human rights, and it is due to this understanding that I feel that we are in ever greater need to voice our concerns. It is my hope that our voices will assist the police in finding a better balance, and thus making our society a better place for everybody.
